We, LIPZ Langkawi are a fully licensed and insured company to perform, market and organize charters, tours, excursions and bookings of any places and tours under the tourism sector in Langkawi:

MOTAC : Licensed as an Inbound/Outbound Travel Agency and Tour Operator under the Ministry of Tourism Malaysia.
MITA : Member of the Malaysian Inbound Travel Association. LIYR : Registered under Langkawi International Yacht Registry.
KLW : Licensed to operate yacht charters under Jabatan Laut Malaysia (Malaysian Maritime Authority).
P&I : Insured by P&I Marine Insurance for Charter services.

RESERVATION / DEPOSIT PAYMENT

Upon confirmation, an official invoice will be sent via email and or WhatsApp within 24-Hours. A booking and confirmation payment of 100% of the invoiced sum must be paid 24-Hours of receiving the invoice. Confirmation of the Bareboat Charter is ONLY upon receiving the full invoiced payment.

CONFIRMATION, CANCELLATION & PAYMENT TERMS (PRIVATE TOURS & GROUP BOOKINGS)

STEP 1: Your request for Private Charters will be communicated ONLY via
EMAIL with company’s quotation, rates and terms.

STEP 2: You are required to settle in full of the total sum to have your Private Charter confirmed.

ALL YACHT CHARTERS ARE INSURED AND LICENSED; LIPZ LANGKAWI WILL MANAGE TO ENSURE THE QUALITY AND PROFESSIONALISM OF THE CRUISE IS ALWAYS CONSISTANT. OUR UTMOST PRIORITY WILL ALWAYS BE THE SAFETY AND THE PROVIDENCE OF EXCELLENCE TO EACH AND EVERY PASSENGER ON BOARD. THIS IS OUR PROMISE TO YOU!

CANCELLATION POLICY

Cancellation of booking must be made in writing. An administrative fee of MYR250.00 will be imposed. However, if the cancellation was made by us LIPZ Langkawi, we will return the full sum without any administrative fee deduction. Below is the cancellation policy if made by you:

1. Seven (7) days before the charter date, a full refund.
2. Any cancellation within the Seven (7) days, NON-Refundable.

Due to the Island’s geographical and wind conditions; it will be incorrect to assume bad weather at Cruise site although weather is extreme at the hotel you reside in. We have experienced Captains to perform the cruise to safe areas as most of the times these extreme showers are passing showers. Please always check with us. As stated above in Cancellation T&C above; the conditions will remain as such for respective refunds and no refunds.

1. All bank charges due via payment made by Telegraphic Transfer (TT) will be strictly borne by the customer.
2. We reserve the right to adjust the payment if paid in foreign currency exchange rate based on our local bank rates to reflect the correct amount to be paid.
3. Credit Card payment in Malaysian Ringgit is accepted with a 2.0% merchant fee respectively.

ITEMS NOT INCLUDED IN CHARTER PRICE

1. Return Transfer and Transportation to and fro the tour departure point. This however can be arranged if needed with the appropriate charges.
2. All items of personal nature.

INSURANCE AND SAFETY

The yacht and charter is fully insured by P&I Marine Insurance, Malaysia covering clients and third party liabilities during the cruise. Children under three (3) years of age, pregnant women and people over the age of seventy (70) are not covered by the insurance and must therefore insure themselves.

LIPZ Langkawi or the Owner of the yacht will not be held responsible for incidents or accidents associated with improper use of equipment whilst on board the vessel including during sea pool or open sea swimming or any water sport activities.

In the interest of safety, we reserve the right to change the planned itinerary with or without prior notice including the routes planned and will decide if conditions fit to make such a passage.

We reserve the right to cancel any trip due to conditions at the last minute in which case a full refund will be given without imposing any administrative fee.

JELLY FISH & OTHER SEA CRITTERS

Although we monitor the situation, as your safety is of the utmost of importance to us, if you have any allergy to stings, we strongly suggest that you stay out of the water. Please be reminded that we will assist you if you get stung by a jelly fish or any other incident occurred during the cruise however LIPZ LANGKAWI AND ALL OF ITS AGENTS will not be held responsible for any incident or accidents in the water as PASSENGERS ARE AT THEIR OWN WILL AND RISK when entering the water.

NON FULLFILLMENT

If we are unable to provide the services agreed and have to cancel the charter can either:

1. Accept the offer to transfer to another vessel or another date and time.
2. Accept the full refund without charging any administrative fee.

No compensation will be paid in the case of unforeseeable and unusual circumstances beyond the owner/charterer control, consequences which could not have been avoided even after all due care has been exercised.

Such circumstances or events includes but are not limited to war, threat of war, riot, civil unrest, industrial dispute, unavoidable technical problem with transport, emergency law declaration, pandemic, closure or congestion of airport or ferry terminal, terrorist activities, natural or nuclear disaster, fire and adverse conditions.

In the event of cancellation due to foul weather prior to scheduled departure time, the cruise/charter may be cancelled with no penalty and the LIPZ Langkawi shall have no liabilities if payment via other agent or hotel. Any payment received directly to LIPZ Langkawi shall be returned if the cruise/charter cannot be rescheduled to another date. This is only upon LIPZ Langkawi cancelling the cruise/charter.

ILLEGAL SUBSTANCE AND/OR ACTIVITY

LIPZ Langkawi reserves the right to stop the cruise/charter at any stage if it is deemed that a passenger or more is under the influence of drugs or is intoxicated with alcohol beyond a responsible level and/or conducts any activity that contravenes with the laws of Malaysia.

INDEMNIFICATION WAIVER

The charterer agrees to release, indemnify and hold the agent, the vessel, the owner, the operator, the captain, the crew/s, the broker and the management and their employees and agents (together the “indemnified parties”) against from any claim or cause of action for injury, death or other damages, whether due to the negligence of the indemnified parties or otherwise, arising from the characters participation in scuba or skin diving/swimming activities, as well as the use of any and all water sports or leisure floatables, vessels and other equipment including but not exclusive diving equipment, jet skis, water skis, tenders, wakeboards, sea-jacuzzi, sea-pool and kayaks.

The charterer recognizes that diving/swimming in open waters/sea as well as the use of any equipment involves certain dangers including equipment failure, adverse sea and weather conditions and negligent acts of fellow participants. The charterer specifically represents and warrants to the indemnified parties that:

1. Is physically fit to dive/swim, has no heart, lung or other medical problems that might be aggravated by these activities.
2. Will not be under the influence of alcohol or any illegal drugs. Moreover, he/she will not take any medication that might adversely affect his/her abilities during the entire charter and activities.
3. Will inspect any and all equipment to be used by him/her, regardless who owns it and is solely responsible for the verifying that the equipment is in good order.
4. Is aware that the vessel has limited medical capabilities and that, in the event of illness or injury, the crew must summon medical assistance. Accordingly, any required treatment will be delayed until the medical assistance arrives. All cost if any is borne by the charterer.

GOVERNING LAW

All disputes relating to the performance of and/or interpretation of any term or provision of this agreement shall be governed by the laws of Malaysia.

This Charter Agreement (Booking) is subject to the following terms and conditions must be read carefully and accepted upon by all involved before making a booking. The charterer has been nominated as the party leader and signs on behalf of all passengers in the party. It is his/her responsibility that all passengers have read, understood and agree at ALL terms and conditions.
